1. INTRODUCTION
1.1 Welcome to the Mindfulpets terms and conditions. Mindfulpets provides a number of services which include training (including for puppies), coaching, education, behaviour therapy and consultations (”Services”) These terms and conditions will apply to any of the Services provided to you by Mindfulpets and may not be varied without our express permission. Mindfulpets reserves the right to update or vary the terms and conditions from time to time.
1.2 Mindfulpets may refuse to provide Services at our sole discretion.
1.3 As part of our Services, Mindfulpets may provide you (“the Client”) with instructions, programmes, advice, information or other work (“Work”). This may be verbally, in writing, electronically or a combination of these.
1.4 The Client may use the Work only in its original form and only for its originally intended use with the animal named and described within the Work. The Client agrees not to sell, transfer, destroy, deface, alter or part with work created by Mindfulpets or permit any third party to do so.
1.5 All Work created by Mindfulpets for the Client is to be used for the sole purpose for which it was created. The Client does not have the right to resell work created by Mindfulpets or repurpose it without written consent from Mindfulpets.
1.6 Without limiting the generality 1.4 and 1.5 above, the Client is not permitted to share with or pass Work to any other dog trainer or behaviourist
2. CHARGES AND PAYMENT
2.2 Current fees are available on the website https://mindfulpets.co.uk/#front-page-5 and https://mindfulpets.co.uk/prices/
2.3 An initial consultation will be required to design the details of the Services to be provided, such as the training plan and number of sessions. Payment for this initial consultation must be made in advance.
2.4 Following the initial consultation, payment for the entire course of sessions must be paid in advance, prior to the first of the sessions.
2.5 Payment must be made by electronic bank transfer unless otherwise agreed by Mindfulpets.
2.6 Once Services are booked and paid for, there is no refund available.
2.7 Services will not commence until payment for the entire course of sessions has been received.
2.8 Ownership of Work shall not pass to the Client until all charges have been paid in full.
3. TIMESCALES
3.1 Whilst Mindfulpets will strive to adhere to any agreed timescales, the Client agrees that timescales will not be an essential part of the agreement. Mindfulpets will not be responsible for any losses to the client if any timescales are not met.
3.2 Mindfulpets cannot always guarantee to start work immediately.
3.3 Mindfulpets reserves the right to cancel or change an appointment at any time by notice with immediate effect, without cause.
4. CHANGES
4.1 Once the Services have been agreed, any modifications requested by the Client will be considered an amendment to the contract and may result in additional charges.
4.2 Any amendments must be agreed by both Mindfulpets and the Client.
5. CANINE REQUIREMENTS
5.1 Dogs must be in good health and have not been ill with any contagious disease or condition within the last 30 days.
5.2 All puppies and dogs must to be up-to-date with their vaccinations, specific for their age group.
6. CANCELLATION
6.1 Mindfulpets may, by written notice, terminate any agreement at its discretion if the Client fails to make any payment which has become due or if the Client breaches any of the terms of the agreement. No refunds will be due.
6.2 The Client understands and accepts that failing to follow, or deviating from the programme, instructions or advice provided by Mindfulpets once the Services have commenced can be harmful to a dog. Therefore Mindfulpets reserves the right to cancel any programme if such failure or deviation occurs. No refund will be due in such circumstances.
6.3 Cancellation by the Client of any appointment which cannot be made at the time, date and location stated when originally booked will result in the full fee being payable unless at least 48 hours notice is given to Mindfulpets.
6.3 If the Client provides at least 48 hours notice of cancellation, the appointment will be rescheduled to a mutually convenient time.
7. LIABILITY
7.1 Mindfulpets does not exclude or restrict liability for death or personal injury caused by our negligence. Subject to this, in no event will Mindfulpets be liable to the client or any third party for damages, injury or losses.
7.2 Mindfulpets shall have no liability under any circumstance whatsoever to the client for financial loss or loss of profit.
7.3 The Client remains responsible for their dog at all times and is advised to ensure they have adequate pet or household insurance cover for liability in the unlikely event of damage or injury caused by their dog to property or to a third party
7.4 Mindfulpets accepts no responsibility for loss of, or injury to, your dog whilst training with us.
8. DISCLAIMERS
8.1 Any information or suggested treatment provided as part of the Services is based on the information given to Mindfulpets by the Client and represents Mindfulpets’s personal views and own conclusions resulting from personally gained evidence of the animal and the related behavioural problem.
8.2 Mindfulpets may also share with or provide to Clients scientific articles or similar materials which may be helpful or informative in relation to the Services being provided. Clients are not permitted to sell, transfer, destroy, deface, alter or part with any such materials or permit any third party to do so.
8.3 Treatment plans and behaviour work, for the most part, will not be successful overnight and require a good deal of patience. Mindfulpets cannot guarantee success, as each animal is an individual case, nor is it possible to foresee if another problem may arise as a result of the treatment. All programs are specific to a certain animal and should not be tried on any other pet, only the animal whose name that appears on the information.
8.4. Any interruption to, deviation from, or discontinuation of the programme, instructions or advice provided by Mindfulpets as part of the Services can be damaging to a dog. Mindfulpets can therefore accept no responsibility or liability for any such action by a Client.
8.5 In the event of any concern, Mindfulpets encourages Clients to contact their veterinary surgeon prior to implementing any treatments or therapies.
8.6 The Client agrees to indemnify and hold harmless Mindfulpets against any and all losses, liabilities, judgments and costs (including legal fees and expenses) arising out of, or related to, any claim of injury to persons or property of any kind when implementing suggested behaviour techniques with your dog.
9. COMMUNICATION
9.1 Mindfulpets’s preferred method of communication is by email. However we can send by traditional post if no email address is available, subject to a postal fee. Reflecting the current postal and packaging rates.
9.2 Mindfulpets shall not be held responsible for spelling mistakes or typing errors to any documents. Signatures are not required to commence this agreement. Verbal communication, email or other exchanges are legally binding.
10. DATA PROTECTION
Mindfulpets takes the protection of Client’s personal information extremely seriously and will comply with all applicable data protection legislation, including the Data Protection Act 2018.
11. USE OF CANINE IMAGES
The Client agrees to permit images of their dogs being used by Mindfulpets on the Mindfulpets website, social media and for marketing purposes. No sharing or disclosure of Client details or the dog’s identity will be made unless with the express permission of the Client.
12. LAW AND JURISDICTION
These terms and conditions and the contract between us are subject to Scottish Law and the non-exclusive jurisdiction of the Scottish courts.
13. DECLARATION
In instructing Mindfulpets to provide Services, the Client confirms acceptance of these terms and conditions.
